These Terms & Conditions ("Terms") govern the services provided by The Library Company ("we," "our," "us") to schools ("you," "your"). By engaging our services, you agree to these Terms.
1. Services Provided
-
We provide library design services, including shelving design and layout.
-
We hire subcontractors for the installation of shelving.
-
We may engage external companies to provide additional services related to library installations.
-
Consultancy is available but limited to library shelving design.
2. Payment Terms
-
A 50% deposit of the total shelving quotation is required upfront.
-
The remaining 50% balance is due upon completion of the job.
-
Other services quoted separately from shelving are payable upon completion, unless otherwise agreed in writing.
3. Cancellation & Refund Policy
-
No cancellations are permitted after the deposit has been paid.
-
The deposit is non-refundable, as it covers material costs and subcontractor expenses.
-
All goods remain the property of The Library Company until they have been paid for in full.
4. Liability & Responsibilities
-
We are responsible for managing subcontractors and ensuring the quality of their work.
-
We accept liability for any defects in subcontractor work and will arrange necessary repairs or replacements.
-
We are responsible for delays caused by subcontractors, but we are not liable for delays due to factors beyond our control (e.g., site conditions, third-party delays, force majeure).
5. Warranty
-
Our shelving comes with a 10-year warranty covering defects in materials and workmanship.
-
We will repair or replace any product, part, or component that fails under normal use.
-
The warranty does not cover damage caused by misuse, accidents, or modifications made after installation.
6. Customer Responsibilities
-
Prior to installation, you must clear the room/area of all furniture.
-
All electrical and decoration work, including new carpet fitting, must be completed at least one day before our installation team arrives, unless otherwise arranged.
-
Any failure to prepare the space may result in delays and additional costs.
7. Disclaimers
-
Our consultancy services only cover library shelving design.
-
We are not liable for any structural issues, electrical problems, or other site-related conditions outside our scope of work.
8. Dispute Resolution
-
In the event of a dispute, we will first attempt to resolve the matter directly with you.
-
If a resolution cannot be reached, the dispute may be referred to mediation or arbitration before legal proceedings.
9. Governing Law & Jurisdiction
-
These Terms are governed by the laws of England and Wales.
-
Any disputes will be subject to the exclusive jurisdiction of the courts of England and Wales.
By engaging our services, you confirm that you have read, understood, and agreed to these Terms & Conditions.
